1. Acceptance of Terms

By accessing or using Block Party Pools ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Age Requirement

You must be at least 18 years of age to use this Service.

By using Block Party Pools, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from or direct any of our content specifically to anyone under 18 years of age. If we learn or have reason to suspect that a user is under 18, we will promptly terminate that user's account.

3. Skill-Based Entertainment Platform

Block Party Pools is a SKILL-BASED entertainment platform and NOT a casino or gambling service.

• All competitions require skill, knowledge, and strategic decision-making
• Success depends on participant expertise in sports, player statistics, and game strategy
• This is NOT a game of chance - outcomes are determined by real sporting events and participant predictions
• We do NOT operate as a casino, gaming establishment, or betting house
• We do NOT offer casino-style gambling, slot machines, or games of pure chance

4. Private Social Pools

Block Party Pools facilitates the organization and management of private social pools among friends, family, coworkers, and social groups. The Service provides tools for:

• Pool creation and customization
• Participant management and tracking
• Score calculation and leaderboards
• Payment coordination (we do NOT process or hold funds)

5. No Money Processing

Block Party Pools does NOT process, hold, or distribute any prize money or entry fees. All financial transactions occur directly between participants outside of our platform. We merely provide payment information fields (Venmo, PayPal) for organizers to share with participants.

6. Legal Compliance

You are solely responsible for ensuring that your use of the Service complies with all applicable local, state, and federal laws in your jurisdiction.

• Some jurisdictions may restrict or prohibit participation in certain pool types
• You must verify that your participation is legal in your location
• Block Party Pools is not responsible for any illegal use of the Service
• We reserve the right to restrict access based on geographic location

7. User Responsibilities

As a user, you agree to:

• Provide accurate and truthful information
• Maintain the security of your account credentials
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to manipulate, exploit, or interfere with the Service
• Respect intellectual property rights
• Honor all financial commitments to pool organizers and participants

8. Pool Organizer Responsibilities

If you create a pool, you agree to:

• Accurately represent pool rules, entry fees, and prize structures
• Distribute prizes fairly and promptly according to stated rules
• Handle all funds responsibly and transparently
• Comply with all applicable laws regarding pool operation
• Resolve disputes among participants in good faith

9. Prohibited Activities

You may NOT:

• Use the Service if you are under 18 years of age
• Create pools for illegal gambling purposes
• Misrepresent yourself or impersonate others
• Engage in fraud, collusion, or cheating
• Harass, threaten, or harm other users
• Attempt to hack, breach security, or disrupt the Service
• Use automated tools or bots without authorization

10. Intellectual Property

All content, features, and functionality of the Service are owned by Block Party Pools and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy of scores, statistics, or calculations. Use at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Block Party Pools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits or revenue
• Loss of data or information
• Disputes between users
• Failure to distribute prizes
• Technical errors or malfunctions

13. Indemnification

You agree to indemnify and hold harmless Block Party Pools from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

14. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, fraudulent activity, or illegal use.

15. Modifications to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or platform notice.

16. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action lawsuit.

These Terms are governed by the laws of the United States and the state in which Block Party Pools is registered, without regard to conflict of law principles.
